Medical Marijuana Laws in Oceanside

The city police department seems to demonize medical marijuana and particularly dispensaries at every turn. If its crime records are to be believed, marijuana has been a factor in one way or another in no less than 45 robberies in the city since 2012, many of them involving firearms.

As a reaction to or as a result of this (perceived) threat, the city council has established a “zero tolerance” policy towards medical marijuana dispensaries since the 2009 when the council members passed an ordinance prohibiting the establishment of medical marijuana dispensaries in the city’s zoning areas. The rationale for this ban was based on a fear for public safety coupled with the fact that marijuana remains a Schedule I drug on the Federal level.

A local cannabis dispensary, Nature’s Leaf collective did fight a protracted legal battle in an attempt to revoke or circumvent the original ordinance. Its numerous attempts, including this 2014 amendment request to the city’s zoning code, all resulted in failure, and they eventually gave up and were forced to finally close down in October 2014. The city shut down two other illegal dispensaries the following year.

The adoption of the MMRSA in 2016 led to several developments in the Oceanside policy regarding medical cannabis. First, as a direct reaction to the new state laws, the city council passed an ordinance reiterating its commitment to prohibiting all commercial activity related to medical marijuana, including cultivation, processing, sale and delivery within city limits. And, despite the passage of Proposition 64 which legalized recreational cannabis use, the city council voted to oppose recreational use while showing its support for medical marijuana.
